Previamente al inicio del presente trabajo se ha realizado una investigación a fondo sobre los nuevos matices que tiene nuestro nuevo código adjetivo civil, habiendo identificado los principales cambios a los que se quiere llegar con este nuevo código, por lo que al estudiar las diligencias de mejor proveer a su alta relación con los principios dispositivos y de igualdad y los posibles problemas que podrían llegar acarrear si esta facultad no es usada de forma correcta, es que se ha decidido ahondar en este tema para realizar un estudio más pormenorizado de esta facultad a efectos de realizar un aporte que pueda servir a futuro a una buena administración de justicia
